Basic Provisions

  • Mission of the library and legal foundation
  1. The Library of the Regional Museum and Gallery in Most, p. o. (hereinafter referred to as OMGMO) is in accordance with its founding document a publicly accessible basic library with specialized collections /specialized library in the sense of § 3, paragraph c./d. of Act No. 257/2001 Coll., as amended

  2. The mission of the OMGMO library is to collect, register, process, and make accessible literary documents of a collection nature, documents documenting cultural, social, economic, technical, and other activities in the region, as well as regional documents from the fields of natural sciences and other documents necessary for the professional work of museum employees and the professional public. Through all its activities, it contributes to the preservation of cultural heritage, the development of science, culture, and the education and upbringing of citizens.

  3. The activities of the library are governed by the following legal regulations:

  • Act No. 257/2001 Coll., on libraries, as amended
  • Decree of the Ministry of Culture No. 88/2002 Coll. for the implementation of Act No. 257/2001 Coll., on libraries and the conditions for the operation of public library and information services, as amended
  • Act No. 122/2000 Coll., on the protection of museum collections, as amended
  • Act No. 121/2000 Coll., Copyright Act, as amended
  • Act No. 101/2000 Coll., on the protection of personal data, as amended
  • The museum library is predominantly a reference library.

 

Library Collections

  • The library collection is divided into two parts:

    1. Collection Fund - contains documents of a collection nature and is registered in the central register of collections of the Ministry of Culture of the Czech Republic (CES) and is subject to the provisions of Act No. 122/2000 Coll. Specifically, it includes: Written documents and prints - Ruk, Books (Old Prints) - St. t. (prints before 1800), Other Conservation Fund - OKF (prints from 1801-1860, interesting and rare prints after 1861, documents originating from the estates of significant regional personalities, etc.), Regional Literature - RK (literature originating from and relating to the region of Mostecko, Krušné hory, Českého středohoří and to a lesser extent other neighboring areas; generally northern Bohemia and adjacent territories across the border in Saxony – Euroregion; Montan-region - literature addressing the relationship between Czechs and Germans in the Mostecko region and northern Bohemia and the life of national minorities in the region).

    2. Specialized Fund - contains documents related to the professional activities and collection fund of the museum published after 1861 (including). Specifically, it concerns the following fields: Regional literature, which broadly covers all fields of human activity and natural sciences in Mostecko or relates to Mostecko, or the entire northern Bohemia, but is not included in the collection fund. Furthermore, history, auxiliary historical sciences, art, literary history, technology, natural sciences (zoology, botany, paleontology, geology, entomology, nature and landscape protection, etc.) and other fields related to the professional activities of the museum and preserved sub-collections. This fund also contains periodicals focused on the aforementioned fields.

  • The library collection is supplemented according to the acquisition plan and the current needs of the museum.

  • The library collections are primarily lent for reference use in the reading room. Documents can be lent out to museum professionals and, in exceptional cases, to other users.

  • From the specialized fund, it is possible to create study reference libraries for individual museum professionals through long-term loans.

  • Library users are obliged to protect the library collections and must not damage them.


Library Users – Their Rights and Obligations

  • A user of the OMGMO library is a person over 15 years of age or a person under 15 years of age accompanied by an adult after registering with library staff. The library processes personal data in accordance with Act No. 101/2000 Coll., on the protection of personal data, as amended, and the General Regulation on the Protection of Personal Data 2016/679 (GDPR).

  • Library users are obliged to comply with these Library Regulations and the instructions of library staff and the Visitor and Researcher Regulations of OMGMO.

  • Library users may move in designated areas. There is a strict prohibition of entry to other parts.

  • Furthermore, researchers are prohibited from opening cabinets, removing books, and manipulating library equipment.

  • In the library premises, users are obliged to maintain silence, cleanliness, and order. Smoking, eating, speaking loudly, or making noise in these areas is not allowed.

  • Users are obliged to comply with the established control measures of the library and museum – i.e., to leave large luggage in lockers in the visitor area, to present a valid personal identification document upon request, and to allow inspection of their hand luggage.

  • Persons who do not comply with the Library Regulations and the instructions of library staff or handle borrowed materials carelessly may be denied access to the library.

  • Persons in a drunken or dirty state, under the influence of other intoxicating substances, or armed (a legally held weapon can be stored in the building in a safe) and animals are not allowed in the library premises. Dangerous substances, weapons, easily flammable materials, etc., must not be brought into or stored in the library premises.

  • Users are entitled to one place in the reading room. In case of full occupancy of places in the reading room, they are obliged to wait for their release outside the library premises or to make an appointment in the library for another date.

  • Readers must not remove catalog cards from catalogs or write on them. They must not interfere with borrowed materials in any way, especially by writing notes, underlining or highlighting text, drawing, tearing out pages, or soiling them, etc.

  • A researcher is obliged to cite the library of the Regional Museum and Gallery in Most, p. o. as a source in their scientific or other works and the signature of the collection fund. Furthermore, in the case of publishing their work, they are obliged to send one copy of it to the library if they have drawn from the museum's collection fund during their study.


Protection of Personal Data of Researchers in the OMGMO Library

  • According to § 13 of Act No. 101/2000 Coll., on the protection of personal data, as amended, and

  • the General Regulation on the Protection of Personal Data 2016/679 (GDPR)

  • The administrator of the personal data of library users is the Regional Museum and Gallery in Most, p. o. (hereinafter referred to as the library)

  • The library processes the personal data of registered users to the following extent:

  • Mandatory identification data: name, surname, date of birth, permanent residence address, ID card number

  • Optional contact data: email, phone

  • Service data: researcher registration number

  • The registered user shall notify the library of any changes to their identification and contact personal data upon repeated visits to the library. The library processes personal data for the purpose of providing library, information, and other services to users, informing users about services, and further for the purpose of protecting property and library collections. This is a legitimate interest of the administrator in protecting library collections – to ensure proper protection of the library collection, the library must have sufficient data for the unambiguous identification of the user to whom the library document is lent.

Rights of Users as Data Subjects

  • The user has the right to access their personal data, to rectify or erase them, or to restrict processing, and the right to object to processing.

  • The library shall provide a registered user with a copy of the processed personal data upon request, or allow inspection of the reader's application and other documents stored with it.

  • Requests from users regarding the protection of personal data are processed by the library without undue delay, no later than one month from the receipt of the request.

Camera System in the Library

  • A camera system is installed in the library. The camera is positioned in such a way as to fulfill its purpose and does not unreasonably interfere with the privacy of the researcher. This is a legitimate interest of the administrator – monitoring public spaces with a camera system for the purpose of increasing the safety of public space and protecting property, especially the library collection from theft or destruction. The protection of the library collection is a significant public interest and as such outweighs the individual interest of the subject not to be monitored, especially since the recordings are not published, access to them is only for library staff, they are used only in accordance with the purpose, and no time records are kept for preservation.

Retention Period of Personal Data

  • The library retains the personal data of registered users for the duration of the existence of the museum library to maintain the continuity of the library's history. This is also a historical record of regional authorities – a special regime for museum libraries and thus a legitimate interest of the administrator. A registered user may request the deletion of their personal data if they have no debts to the library and do not wish to continue using its services.

Security of Personal Data

  • Documents are stored in such a way as to prevent unauthorized access by usual means. Access to these documents is limited only to employees who work with them as part of their job duties.

Additional Information

  • The library processes personal data based on a service contract concluded with the user upon acceptance of their application to the library, and in accordance with the General Regulation on the Protection of Personal Data (EU) 2016/679 (GDPR).


Health and Safety at Work (BOZP)

  • The researcher is obliged to comply with all safety regulations, the Fire Safety Regulations, and to follow the instructions of library staff. The Fire Safety Regulations prepared for the library are visibly placed in the reading room, and the researcher is obliged to familiarize themselves with it upon registration.

  • Library users are strictly prohibited from touching or manipulating the technical equipment of the reading room – i.e., with valves and heating body shut-offs, lighting equipment, electrical installations (circuit breakers, electrical outlets, electrical wiring, etc.), fire extinguishers (except in the case of extinguishing a fire – see Fire Safety Regulations), and windows. Any requests (ventilation, etc.) should be directed to library staff.


Loan Regulations and Other Services

  • The library lends books and other documents from its collections to non-museum researchers for reference study only in the reading room. Rare prints and manuscripts are excluded from regular lending and can only be lent under conditions set by OMGMO.

  • All loans are made only through library staff.

  • The researcher is obliged to remain only in the reading room and to follow the instructions of library staff. A researcher who is not a museum employee must fill out a reader's application during their first visit, where they truthfully provide their name, surname, ID number, date of birth, permanent residence, phone, email, and other data. By signing, they commit to comply with the Library Regulations.

  • The maximum number of concurrently borrowed bound volumes or individual issues of periodicals in the reading room is set at 20 pieces. In case of a need for a higher number of concurrently borrowed volumes, the decision on permission is left to the library staff. Rare materials are lent only individually, with a maximum of 5 pieces.

  • Outside the reading room, only museum employees may borrow books and other materials to their workplaces, for which they are responsible for the entire duration of the loan. The employee confirms receipt of the book with their signature in the loan book. At the request of the library, employees are obliged to return specific volumes immediately and allow their study by other users. They are also not allowed to lend them to third parties.

  • Before terminating their employment, a museum employee must provide confirmation that they have no obligations to the OMGMO library. The confirmation will be issued by library staff.

  • In exceptional and duly justified cases, the director of OMGMO may allow the loan of documents from the specialized fund dated after 1900 to non-museum users, with the conditions of such a loan being set ad hoc.

  • Lending for exhibition purposes to another organization can only be carried out based on a proper loan agreement signed by the director of OMGMO.


Interlibrary Loan Service

  • The library will facilitate the loan of a document not in its collections upon the user's request through the interlibrary loan service (MVS). However, this service does not apply to the library's collection funds and damaged books and periodicals.


Information and Bibliographic Services

  • The library builds and provides access to an information apparatus in the form of various types of catalogs and card files and in the database of electronic catalogs. It provides the public with oral and written information of a factual, bibliographic, reference, and library nature. The library's specialized card files are not publicly accessible.


Copying Services and Reproduction

  • The library provides copying services – copies are made on a standard copying machine. Copies are intended solely for the personal use of the requester, who is obliged to handle them in accordance with the relevant provisions of the Copyright Act.

  • The library staff is authorized to determine which materials may be excluded from copying, for example, due to the risk of further damage, or if making a copy is contrary to legal regulations, etc.

  • The prices of copies are listed in the Price List of Services. (Appendix No. 1).

  • The researcher may, with the express permission of library staff, make reproductions of borrowed books using their own device, provided that this device does not affect the physical condition of the book.


Computer Workstation

  • The library's computer workstation is intended for free use of electronic information sources (including CDs, DVDs) of the museum library and for accessing freely available bibliographic data from the internet, etc. It cannot be used for personal purposes unrelated to research (e.g., entertainment, pornography, sports, etc.).

  • The researcher must not turn the computer or its other technical accessories (printer, etc.) on or off. Users are prohibited from using any software on the library's computers other than that provided to them. It is prohibited to install any software on the computer.

  • All obtained information and data (in any form and on any medium) are intended solely for the personal needs of the user and their study purposes. It is not allowed to further disseminate, reproduce, copy, sell, or otherwise use them.

  • The user bears full responsibility for any interventions in the computer's configuration – for example, for damages caused by unprofessional handling or caused by viruses introduced by them.

  • The operation of the museum library network (computers) may be limited or interrupted for necessary maintenance of the network (computers) or for other serious reasons.

  • When using the internet, the researcher is obliged to consider other library users and may accept the time limit set by the library.


Fees and Compensation

  • The library provides basic services free of charge. However, it charges users for other costs associated with processing their requests, such as postage for MVS, etc. It also imposes fines on users for failing to return loans on time (see Price List of Services, Appendix No. 1).

  • Fees for copying services are set in the Price List of Services.

  • Compensation for books and other documents damaged or lost by the user can be made in the following ways:

    1. Restoration to original condition (professional restoration at the user's expense)

    2. Providing an undamaged copy of the same work in the same edition and binding

    3. If neither of the above options is feasible, the library will require:

    4. Providing a bound copy or full reimbursement of the costs for its acquisition

    5. Providing another edition of the same work

    6. Providing another work of comparable value

    7. Financial compensation according to the current market price of the work

  • If a user damages technical equipment of the library (computers, reading devices, etc.) through unprofessional handling, they will cover all costs associated with the repair or acquisition of new equipment (in the case of irreparable damage).

  • Until the method of compensation for the loss is resolved and all claims are settled, the library has the right to suspend the provision of all services to the user.

  • An integral part of these regulations are the appendices:

    3. Appendix No. 3: Research Days for Non-Museum Researchers

    4. Appendix No. 4: Depository Regime in the Depository of the Library's Collection Fund and in the Warehouse of the OMGMO Library's Specialized Fund

  • This library regulation comes into effect on 1 February 2019

  • The library regulation from 1 April 2017 is hereby repealed.

Appendix No. 1 of the OMGMO Library Regulations

PRICE LIST OF SERVICES OF THE REGIONAL MUSEUM AND GALLERY IN MOST, P. O. - CONTRACTUAL PRICES

The library provides reprographic services for researchers for the purpose of copying information in accordance with the Copyright Act. In case of increased demands for the quality of image attachments, it is possible to request high-quality photocopies from the professional staff of OMGMO. To the base price of services, a surcharge of 0.20 CZK (for a black and white page) or 0.40 CZK (for a color page) is charged according to the Copyright Act. The amounts are paid to the relevant collective administrator as stipulated by the aforementioned law.

  • Copying format A4: single-sided 2.00 CZK

  • Copying double-sided 4.00 CZK

  • Copying format A3: single-sided 4.00 CZK

  • Copying double-sided 8.00 CZK

  • Printing format A4: single-sided 2.00 CZK

Appendix No. 2 of the OMGMO Library Regulations

REQUEST FOR CONSENT TO USE OWN REPRODUCTION DEVICE

I hereby request, according to Act No. 121/2000 Coll., the Copyright Act, as amended, to allow the use of my own reproduction device (camera or scanner) for my personal use.

I declare that reproductions made using my own reproduction device will be used only for my own study purposes and will not be published. I also declare that in case of interest in publishing reproductions made by me, I am obliged to pay the museum a reproduction fee according to the Price List of services provided by the museum, or to request a waiver of it. I am also aware of the necessity to settle any copyright and related rights.

I agree to the prohibition of using a flash on the camera.

Appendix No. 3 of the OMGMO Library Regulations

RESEARCH DAYS FOR NON-MUSEUM RESEARCHERS

Tuesday-Wednesday: 8.00-11.00 12.00-15.00

Friday: 8.00-11.30

Prior arrangement by phone, email, or in person is necessary. In case of prior individual arrangement, it is possible to extend the time on research days on Tuesday and Wednesday until 18.00.

Appendix No. 4 of the OMGMO Library Regulations

DEPOSITORY REGIME IN THE DEPOSITORY OF THE LIBRARY'S COLLECTION FUND AND IN THE WAREHOUSE OF THE OMGMO LIBRARY'S SPECIALIZED FUND

It is based on Act No. 257/2001 Coll., on libraries and Act No. 122/2000 Coll., on the protection of museum collections.

The depository regime stipulates:

the movement of persons in the depository and storage areas of the library; securing the funds against harmful environmental influences; handling documents and others.

  1. Movement of persons in the depository of collection funds and storage areas of the library

    • Access to these areas is granted only to librarians and other persons only in their company.

    • If not possible otherwise, the librarian may authorize another museum employee to accompany a foreign person (maintenance work, security technology, cleaning, etc.)

    • In other cases, entry to the depository and storage areas is only possible commissionally, with this entry being recorded in the depository log (stored in the depository of collection funds).

    • Cleaning staff are allowed into storage areas by the librarian, but for practical reasons, they are left alone during cleaning. After the work is completed, they are recorded in the depository log (see above). Subsequently, the storage areas are checked and locked by the librarian.

  2. Securing and protecting the fund against harmful environmental influences, monitoring the current state of the environment in the depository of the library's collection funds and other storage areas

    • Daily, library staff checks the condition of all library areas (with an emphasis on closing windows, identifying signs of unauthorized entry, accidents, etc.).

    • In the depository of collection funds, temperature and relative humidity are recorded daily in the depository log. Furthermore, the movement of foreign persons and other events that deviate from normal operations are recorded. Ventilation in the depository of collection funds is minimal, and only during dry and cool weather. The reason is the necessity to maintain stable humidity and temperature without significant fluctuations, as well as outdoor dustiness or the risk of insect intrusion from the adjacent park, etc. Ventilation is primarily done through doors to other library areas.

  3. Handling of the library's collection funds

    • Documents of a collection nature may only be removed from the depository in the presence of library staff or commissionally. Before closing the library, historical collection funds are returned to the depository and are not left in the reading room and office. Exceptions are documents exhibited in exhibitions and museum displays. Loans of collection funds outside the building are subject to special regulations.

    • If a professional museum employee needs to borrow a collection document to their office outside the library for an absolutely necessary period, they are obliged to sign an internal receipt for acceptance in advance.
